Terms of service
General Terms and Conditions
1. Scope
(1) These General Terms and Conditions ("Terms") apply to all contracts concluded via the online shop www.wardow.com between WARDOW GmbH, Magdeburger Straße 5, 14641 Wustermark, Germany (hereinafter "WARDOW" or "we") and you as the customer. The version in effect at the time of the order shall apply.
(2) A consumer within the meaning of these Terms is any natural person who concludes the contract for purposes that cannot predominantly be attributed to either their commercial activity or their independent professional activity.
(3) Individual agreements made with you shall take precedence over these Terms. Deviating, conflicting or supplementary terms and conditions of the customer shall only become part of the contract if we have expressly agreed to their validity.
2. Conclusion of contract
(1) The presentation of products in the online shop does not constitute a legally binding offer, but a non-binding invitation to place an order.
(2) By submitting the order via the "Buy now" button, you submit a binding offer to purchase the goods contained in the shopping basket. The order confirmation sent immediately afterwards by email merely documents receipt of your order and does not yet constitute acceptance.
(3) The purchase contract is concluded when we accept your order within five days by sending a dispatch confirmation by email, or when we dispatch the goods within this period. If we do not accept your order within this period, this shall be deemed a rejection, with the consequence that you are no longer bound by your order; any payments already made will be refunded without delay.
(4) In the case of prepayment, delivery takes place once the full amount has been credited to our account. If payment, despite being due and following a further reminder, is not received within 7 calendar days of the order confirmation being sent, neither party shall remain bound by the contract.
(5) Sales are made only in quantities customary for household use. We do not offer products for purchase by minors.
(6) The contract is concluded in the language in which the online shop and the ordering process are displayed to you. We store the text of the contract; you will receive the order details and these Terms by email. You may view, print or save these Terms at any time at www.wardow.com.
3. Prices and shipping costs
(1) The prices stated at the time of the order shall apply. Prices are final prices and include the applicable statutory value added tax. For deliveries to countries outside the European Union, additional customs duties, taxes and charges may apply, which you shall bear.
(2) In addition to the prices, shipping costs apply, which depend on the delivery destination and the chosen shipping and payment method. Shipping costs will be shown to you during the ordering process (checkout) before you place your order.
(3) In the case of partial deliveries that we make without prior consultation with you, follow-up deliveries are carried out at no additional shipping cost to you.
4. Delivery; unavailability; transfer of risk
(1) Delivery is carried out by our shipping partners to the delivery address you have provided. Delivery areas and estimated delivery times are stated in the online shop.
(2) If an ordered item is not available within a foreseeable period through no fault of our own, despite having entered into a corresponding, timely covering transaction with our supplier, both parties shall be entitled to withdraw from the contract to that extent. In this case, we will inform you of the unavailability without delay and refund any payments already made without delay. Your statutory rights remain unaffected.
(3) For consumers, the risk of accidental loss and accidental deterioration of the goods only passes upon delivery to you or a recipient designated by you; this applies regardless of whether the shipment is insured.
5. Payment
(1) The payment methods available for your order – in particular credit card (e.g. Visa, Mastercard, American Express), wallets (e.g. Apple Pay, Google Pay), PayPal, Klarna, as well as further local payment methods depending on the delivery country – will be shown to you during the ordering process; these may vary depending on delivery country, currency and order. We reserve the right not to offer certain payment methods in individual cases; at least one common and free-of-charge payment method will always be available to you.
(2) Card payments, wallets and local payment methods are processed via the payment service Shopify Payments, a service provided by Shopify International Limited, 1–2 Victoria Buildings, Haddington Road, Dublin 4, Ireland.
(3) If you select a payment method offered by PayPal, payment processing is carried out by PayPal (Europe) S.à r.l. et Cie, S.C.A., 22–24 Boulevard Royal, L-2449 Luxembourg, under PayPal's terms of use.
(4) Payments via Klarna are processed – depending on the delivery country and currency – by Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden, or by Shopify Payments. The use of some payment methods requires a positive credit check. Further information, as well as Klarna's terms of use and privacy policy, can be found during the ordering process and at www.klarna.com.
(5) For purchases on invoice, the purchase price is due for payment on the day the delivery is received.
(6) We make invoices and credit notes available to you in electronic form.
6. Retention of title
The goods remain our property until full payment has been made.
7. Statutory right of withdrawal
Consumers have a statutory right of withdrawal in respect of orders placed in our online shop. Details on the requirements and legal consequences can be found in our withdrawal information, including the model withdrawal form, which you can find during the ordering process and at any time at https://wardow.com/policies/refund-policy.
8. Voluntary 30-day return policy
(1) In addition to the statutory right of withdrawal, we grant you a voluntary right of return of a total of 30 days from receipt of the goods. This allows you to withdraw from the contract even after the statutory withdrawal period has expired, by returning the goods within 30 days of receipt (the period begins on the day after receipt of the goods) to WARDOW GmbH, Magdeburger Straße 5, 14641 Wustermark, Germany; timely dispatch is sufficient. This is subject to the condition that you have only tried the goods to the extent that would be possible in a physical shop, and that you return them complete, undamaged and in their original sales packaging. The voluntary right of return does not apply to gift cards.
(2) The refund will be made using the payment method used for the payment.
(3) Your statutory right of withdrawal and your statutory warranty rights remain unaffected by this voluntary right of return. Until the statutory withdrawal period expires, only the statutory conditions shall apply.
9. Warranty; transport damage
(1) The statutory provisions on liability for defects apply.
(2) If goods are delivered to you with obvious transport damage, please report this to the carrier immediately, where possible, and contact us. Failure to do so has no effect on your statutory rights, in particular your warranty rights; however, it helps us assert our own claims against the carrier or the transport insurer.
10. Liability
(1) We shall be liable without limitation for intent and gross negligence, for culpable injury to life, limb or health, in the event of the assumption of a guarantee, and pursuant to the mandatory provisions of product liability law.
(2) In the event of a slightly negligent breach of material contractual obligations (obligations, the fulfilment of which enables the proper performance of the contract in the first place and on whose observance you may regularly rely), our liability shall be limited to the foreseeable damage typical of this type of contract. Otherwise, liability for slight negligence is excluded.
(3) Mandatory statutory liability provisions remain unaffected by the above limitations.
11. Discount vouchers
(1) Discount vouchers (vouchers that we issue free of charge as part of promotional campaigns with a specified validity period) can only be redeemed in the specified online shop, within the specified period, and only once per order. Individual brands may be excluded from a voucher promotion; we will indicate this in the promotion's terms.
(2) Discount vouchers can only be redeemed before the ordering process is completed and cannot be combined with other discount vouchers. Subsequent offsetting, cash payment or interest accrual is not possible.
(3) The value of the goods must be at least equal to the amount of the discount voucher. If the credit is not sufficient, the difference may be paid using the payment methods offered.
(4) If goods are returned in whole or in part, a discount voucher issued free of charge will not be refunded; the amount actually paid by you will be refunded.
12. Applicable law; jurisdiction; dispute resolution
(1) The law of the Federal Republic of Germany shall apply to all legal relationships between the parties, excluding the United Nations Convention on Contracts for the International Sale of Goods. If you are a consumer and have your habitual residence in another state, this choice of law shall only apply to the extent that it does not deprive you of the protection afforded to you by the mandatory provisions of the law of the state of your habitual residence; you may always also rely on those provisions.
(2) If the customer is a merchant, a legal entity under public law or a special fund under public law, or does not have a general place of jurisdiction in Germany, the exclusive place of jurisdiction for all disputes arising from this contract shall be our registered office (Wustermark). In this case, we shall also be entitled to bring proceedings at the customer's place of business.
(3) We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
